Fento LLC and its affiliates (“Fento,” “we,” “our,” and/or “us”) value the privacy of individuals who use our websites, dashboards, applications, product catalog, storefront tools, checkout experiences, order and fulfillment services, and related services (collectively, our “Services”). This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information from or about users of our Services. If you are located in the European Economic Area (“EEA”) or the United Kingdom, “personal information” means any information relating to an identified or identifiable individual. This Privacy Policy applies to visitors of our websites, prospective merchants, and merchants who use our Services to source, customize, sell, and fulfill products through Fento’s platform (“Merchants”).
In addition to the activities described in this Privacy Policy, we may process personal information provided by Merchants when they use our Services. Merchants use our Services to run their businesses, select and customize products, manage orders, operate storefronts or sales channels, and sell products to their end customers. In doing so, Merchants may collect personal information about their end customers, including, for example, names, email addresses, mailing addresses, order details, payment-related information, customer service communications, and other information necessary to process and fulfill orders. Where Fento processes personal information of a Merchant’s end customers on behalf of that Merchant, Fento acts as a data processor or service provider, as applicable, on the Merchant’s behalf and pursuant to the Merchant’s instructions. The Merchant is responsible for its own collection and processing of end-customer personal information. To understand how a Merchant processes your personal information, please refer to that Merchant’s privacy policy.
By using our Services, you agree to the collection, use, disclosure, and other processing of your personal information as described in this Privacy Policy. Beyond this Privacy Policy, your use of our Services is also subject to Fento’s Terms of Service and any applicable additional terms.
PERSONAL INFORMATION WE COLLECT
A. Information You Provide to Us
Account and profile information. If you create a Merchant account, contact us, request access, or use the Services, we may collect your name, email address, phone number, company name, social media links, storefront URLs, business address, username, password, role, team information, and other account or onboarding details.
Merchant business information. We may collect information about your brand, audience, sales channels, product interests, product selections, product designs, artwork, logos, packaging requirements, catalogs, SKUs, product requests, store preferences, business volume, order history, payout information, tax forms, compliance documentation, and other information needed to provide the Services.
Payment and payout information. If you make or receive payments through the Services, we and our payment processors may collect payment card information, bank account information, billing address, tax identification information, identity verification information, payout method details, transaction records, chargeback information, and related financial data. We generally rely on payment processors such as Stripe or other providers to process payment card and bank information.
Order and customer information. When products are purchased, shipped, returned, or supported through the Services, we may collect end-customer information such as name, email address, phone number, shipping address, billing address, order details, product selections, tracking information, support messages, refund requests, and transaction information.
Communications. If you communicate with us, respond to forms, request support, submit a product request, or communicate with us through email, chat, social media, or other channels, we may collect your contact details and the content of those communications. We may also track whether you open or engage with certain emails to improve our communications and Services.
User content and design materials. We may collect files, images, text, logos, artwork, mockups, product descriptions, comments, product specifications, and other materials you upload or provide for use in product customization, storefronts, fulfillment, marketing, or support.
B. Information We Collect Automatically
Device and usage information. We may automatically collect information about your device and use of the Services, including IP address, browser type, operating system, device identifiers, referring URLs, pages viewed, searches, clicks, session times, log files, performance data, diagnostics, and interactions with product catalog, dashboard, checkout, or support features.
Cookies and similar technologies. We and our partners may use cookies, pixels, SDKs, local storage, and similar technologies to operate the Services, remember preferences, secure accounts, analyze usage, measure performance, support marketing, and improve user experience. Some cookies are necessary for the Services to work; others may be used for analytics or marketing where permitted by law.
Approximate location. We may infer your approximate location from your IP address or other technical information, such as country, region, or city, to support security, localization, analytics, fraud prevention, tax, and logistics functions.
C. Information We Receive from Third Parties
We may receive information from third-party platforms and service providers, including payment processors, identity verification providers, shipping carriers, analytics providers, advertising and marketing partners, storefront platforms, marketplace platforms, social media platforms, logistics providers, suppliers, tax providers, fraud prevention providers, and publicly available sources. This information may include account identifiers, transaction data, fulfillment data, tracking data, business verification details, customer communications, or platform compliance information.
HOW WE USE PERSONAL INFORMATION
- Provide, operate, maintain, secure, and improve the Services, including product catalog, account, dashboard, checkout, order, fulfillment, payout, logistics, and support features.
- Create and manage Merchant accounts, verify identity or business information, onboard Merchants, administer access permissions, and provide customer support.
- Process product selections, customization requests, orders, payments, payouts, refunds, returns, chargebacks, shipment tracking, and fulfillment activities.
- Communicate with you about the Services, including account notices, product updates, order updates, support, security alerts, billing, payouts, marketing, and administrative messages.
- Analyze and improve the Services, develop new products and features, generate aggregated or de-identified insights, understand product trends, and provide market intelligence.
- Detect, investigate, and prevent fraud, security incidents, abuse, policy violations, unlawful activity, payment risk, chargebacks, and other trust-and-safety issues.
- Comply with legal, tax, accounting, customs, sanctions, reporting, audit, and compliance obligations, and enforce our rights and agreements.
- Carry out any other purpose disclosed to you at the time the information is collected or with your consent.
LEGAL BASES FOR PROCESSING EUROPEAN PERSONAL INFORMATION
If you are located in the European Economic Area or the United Kingdom, we process your personal information only when we have a valid legal basis, including:
- Contractual necessity, such as to provide the Services you requested, create and manage your account, process orders, payments, fulfillment, support, and payouts.
- Legitimate interests, such as improving the Services, securing the platform, preventing fraud, analyzing business performance, developing features, and communicating with Merchants, where those interests are not overridden by your rights and interests.
- Consent, such as where required for certain cookies, marketing communications, or optional features.
- Compliance with legal obligations, such as tax, accounting, customs, sanctions, law enforcement, consumer-protection, and regulatory requirements.
HOW WE DISCLOSE PERSONAL INFORMATION
We may disclose personal information as described below or as otherwise disclosed at the time of collection.
Affiliates. We may share personal information with our affiliates for purposes consistent with this Privacy Policy.
Vendors and service providers. We may share personal information with vendors, contractors, and service providers that help us operate the Services, including hosting providers, payment processors, identity verification providers, email providers, analytics providers, customer support tools, suppliers, manufacturers, warehouses, logistics providers, shipping carriers, customs brokers, tax providers, fraud prevention providers, and professional advisors.
Merchants and end customers. If you are an end customer, we may share order, shipping, refund, and support information with the Merchant associated with your purchase. If you are a Merchant, we may share necessary product, order, shipping, and customer information with your team members, sales channels, suppliers, carriers, and other providers as needed to provide the Services.
Third-party platforms. If you connect or use third-party services, such as storefront platforms, marketplaces, social media platforms, payment processors, or analytics tools, we may disclose information to those services at your direction or as necessary to provide the integration. Third-party services process information under their own terms and privacy policies.
Public areas of the Services. Information you choose to make public, such as storefront content, product listings, brand profiles, social links, images, descriptions, or other publicly available materials, may be visible to anyone.
Analytics and marketing partners. We may disclose information to analytics and advertising partners to understand usage, improve the Services, measure campaigns, and market Fento, subject to applicable law and cookie consent requirements.
Legal, safety, and enforcement. We may access, preserve, or disclose personal information if we believe doing so is necessary or appropriate to comply with law, legal process, government requests, tax or customs obligations, enforce our terms, detect or prevent fraud, protect rights, property, or safety, or respond to disputes.
Corporate transactions. We may disclose or transfer personal information in connection with an actual or potential merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction.
Consent. We may disclose information with your consent or at your direction.
COOKIES AND TRACKING CHOICES
You may be able to control cookies through your browser settings. If you disable cookies, some features of the Services may not function properly. Where required by law, we will obtain consent for non-essential cookies or provide choices regarding analytics and marketing technologies. The categories of personal information we collect may include identifiers, commercial information, internet or network activity information, geolocation information at an approximate level, professional or business information, financial and transaction information, and inferences derived from the foregoing. We collect and disclose these categories for the purposes described in this Privacy Policy.
Fento does not knowingly sell personal information for money. Some analytics or advertising activities may be considered a "sale," "sharing," or targeted advertising under certain state privacy laws. Where required, we will provide mechanisms to opt out of such activities. We do not knowingly sell or share personal information of individuals under 16 years of age.
DATA PROCESSING ON BEHALF OF MERCHANTS
When Fento processes end-customer personal information on behalf of a Merchant in connection with fulfillment, support, storefront operations, or related services, the Merchant may be responsible for providing required privacy notices, obtaining necessary consents, and responding to customer privacy requests. Fento will process such information as reasonably necessary to provide the Services, comply with law, and protect the Services, or as otherwise agreed in a separate data processing agreement or applicable terms.
DATA RETENTION
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain business records, comply with legal, tax, accounting, customs, audit, and reporting obligations, resolve disputes, prevent fraud, enforce agreements, and protect our rights. The retention period may vary depending on the nature of the information and our relationship with you.
SECURITY
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for protecting your account credentials and promptly notifying us of any suspected unauthorized access.
CHILDREN’S PRIVACY
